Terms of Service
Terms governing your use of the Clima platform for selling and purchasing digital products.

Welcome to Clima.
These Terms of Use (“Terms”) govern your access to and use of the Clima platform, including the website, services, and related technologies (collectively, the “Service”). By accessing or using Clima, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
1. Description of the Service
Clima provides a platform that allows creators ("Sellers") to sell digital products through customizable public pages and shareable links.
Customers ("Buyers") may purchase products directly from creator pages.
Clima provides tools for: product listings; payment processing through Stripe; order notifications; and basic analytics.
Clima is not the seller of any products listed on the platform. Transactions occur directly between the Seller and the Buyer.
2. Eligibility
You must be at least 18 years old to create an account or use Clima as a seller.
By using the platform you represent that: you are at least 18 years old; and you have the legal authority to enter into these Terms.
3. Accounts
To access certain features, you may need to create an account.
You agree to: provide accurate information; maintain the security of your account; and notify us of unauthorized access.
You are responsible for all activity under your account.
4. Seller Responsibilities
Sellers are responsible for: ensuring products comply with applicable laws; accurately describing products; delivering purchased products as described; and responding to buyer inquiries when necessary.
Clima does not guarantee product delivery or quality. Clima does not control or verify the content listed by sellers.
5. Payments
Payments are processed through Stripe. Clima does not store or process credit card information. By using Clima you agree to Stripe's terms and policies.
Sellers are responsible for: complying with Stripe requirements; and managing refunds and disputes when applicable.
Clima may charge platform fees as described on the website.
Sellers are solely responsible for issuing refunds, handling customer support, and resolving payment disputes related to their products.
Sellers are the merchant of record for all transactions conducted through their Clima pages.
6. Delivery of Products
Sellers may provide products through: download links; external product access links; or manual delivery.
Clima may include delivery links in purchase confirmation emails when provided by the seller. Sellers are responsible for fulfilling orders.
7. Acceptable Use and Prohibited Businesses
You agree not to use Clima to: violate laws; distribute illegal or harmful content; infringe intellectual property rights; distribute malware or malicious links; impersonate other individuals or businesses; or engage in fraud or deceptive practices.
We reserve the right to suspend or terminate accounts that violate these Terms.
Sellers must also comply with the prohibited and restricted business categories defined by Stripe. Certain types of businesses and products are not permitted on Clima due to payment processor policies. A current list of restricted businesses can be found here
8. Intellectual Property
Clima and its content, including branding, software, and design, are protected by intellectual property laws.
You may not copy, distribute, or modify Clima's platform without permission. Sellers retain ownership of the content they upload.
9. Platform Availability
We may modify, suspend, or discontinue parts of the Service at any time. We do not guarantee uninterrupted access.
10. Third-Party Services
Clima integrates with third-party services including: Stripe; cloud infrastructure providers; and email delivery services. Use of these services may be subject to their own terms and policies. Clima is not responsible for third-party services.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available." We do not guarantee that: the platform will always be available; the platform will be error-free; or sellers will fulfill purchases.
12. Limitation of Liability
To the maximum extent permitted by law, Clima is not liable for: indirect damages; loss of profits; loss of data; or disputes between buyers and sellers.
Our total liability will not exceed the amount paid to Clima in the previous six months.
13. Disputes Between Buyers and Sellers
Clima is not responsible for disputes between buyers and sellers. Buyers and sellers agree to resolve disputes directly with each other. Clima may assist in limited circumstances but has no obligation to do so.
14. Termination
We may suspend or terminate accounts that: violate these Terms; engage in fraudulent activity; or misuse the platform.
Users may terminate their account at any time.
Clima may remove products, listings, or content that violate these Terms or applicable laws.
15. Changes to the Terms
We may update these Terms from time to time. Continued use of Clima after updates means you accept the new Terms.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
